4. SMS Communications

NerdieTech Systems offers two types of SMS text messages you may opt in to receive:

  • Marketing messages: Promotions, special offers, discounts, and business updates.
  • Non-marketing (informational) messages: Order updates, appointment reminders, account notifications, and service-related communications.

By opting in to receive text messages from NerdieTech Systems:

  • You confirm that you are the owner or authorized user of the mobile phone number provided.
  • You understand that consent is not required to make a purchase.
  • You must be at least 18 years of age to opt in. By opting in, you confirm that you are 18 years of age or older.

Opt-Out Instructions

You may opt out at any time by texting STOP to any message you receive from us. After texting STOP, you will receive a one-time confirmation message confirming that you have been unsubscribed. You will no longer receive text messages from NerdieTech Systems after opting out. If you wish to rejoin, you may text START or re-submit the opt-in form on our website.

Message Frequency & Rates

  • Message frequency may vary.
  • Message and data rates may apply depending on your mobile carrier plan. Contact your carrier for details about your messaging plan.
  • Carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator and is outside of our control.

5. Payment Terms

For paid services:

  • Prices are as quoted during consultation or as listed on our website.
  • Setup fees are one-time charges and are non-refundable once work has begun.
  • Monthly subscriptions are billed on a recurring monthly basis.
  • We offer a 14-day satisfaction guarantee on monthly subscription fees.
  • You may cancel your subscription at any time with no penalties.

6. Intellectual Property

All content, trademarks, logos, and intellectual property on the NerdieTech Systems website are owned by NerdieTech Systems or its licensors. You may not reproduce, distribute, or create derivative works without our written permission.

7. Data Ownership

Your business data, customer lists, and content that you provide or generate through our platform remain your property. If you cancel your subscription, we will assist you in exporting your data.

8. Limitation of Liability

NerdieTech Systems shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services. Our total liability shall not exceed the amount you paid for the Services in the twelve months preceding the claim.

9. Disclaimer of Warranties

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee specific results from using our Services, including but not limited to increases in revenue, leads, or customer engagement.

10. Indemnification

You agree to indemnify and hold harmless NerdieTech Systems, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of our Services or your violation of these Terms.

11. Termination

We reserve the right to suspend or terminate your access to our Services at any time for violation of these Terms or for any other reason at our discretion. Upon termination, we will assist with data export as described in Section 7.

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law provisions.
